SUBJECT OF THE CONTRACT
These General Terms and Conditions apply to all visitors to the “Wiener Opernsommer” event and to the purchase of tickets via the online ticket store.

EXCHANGE / RETURN / CANCELLATION OF TICKETS
Since the organizer provides a service for leisure activities in accordance with these General Terms and Conditions and a specific time has been agreed for this, the right of withdrawal in distance selling according to Section 11 FAGG is excluded in accordance with Section 18 Paragraph 1 Z 10 FAGG. A withdrawal from the purchase contract is therefore not possible. Before purchasing, please check whether the date, number of tickets and category are displayed correctly in the shopping cart. A replacement for tickets that are not used or only partially used (e.g. due to late arrival) is excluded, as is a replacement for lost tickets.

RETURN OF PURCHASED TICKETS DUE TO STORM WEATHER
If the event cannot take place due to bad weather (storm, thunderstorm, etc.), an alternative date will be offered and the tickets purchased will remain valid for this alternative date. A refund of the ticket price in the event of a no-show is excluded. If a rebooking is not possible, you will receive your money back in accordance with the GUIDELINES FOR TICKET REFUNDS.

There are special guidelines for premiere tickets, which remain valid for an alternative date in the event of cancellation (see paragraph PREMIERE TICKETS).

TICKET REFUND POLICY
If a performance gets cancelled within the first 45 minutes of the opera, you are entitled to a refund of the ticket price. Please follow the steps below for a hassle-free refund:

RETURN OF TICKETS
If you purchased your tickets from an advance booking office you can return your tickets only at the same advance booking office where you have purchased them. Tickets purchased ONLINE will be automatically refunded according to the following conditions.

TERMS OF REFUND
The refund includes the full ticket price minus any shipping charges or other fees (e.g. system fees) incurred at the time of purchase. Please note that for organizational reasons, refunds cannot be made directly at the box office or ticket office. We regret any inconvenience caused by a performance cancellation and thank you for your understanding and cooperation.

PREMIERE TICKETS FOR JULY 1ST
Premiere tickets remain valid for an alternative date in the event of cancellation due to weather conditions and will not be refunded.

SHORT-TERM SHIFTS
If the weather conditions on the day of the event conflict with the planned regular course of the event, the organizer reserves the right to postpone the start before deciding and announcing whether the event must be canceled. The organizer reserves the right to interrupt and later continue the event. The decision is the responsibility of the organizer and is made by him on site. In the event of bad weather, the event can be canceled at the earliest at the scheduled start.

A short-term postponement of the start of the event does not entitle the customer to return tickets. Customers are responsible for informing themselves about any changes on the day of the event (e.g. online on the organizer's website or social media channels).

RIGHT OF RESIDENCE
You may only enter the event venue with a valid admission ticket. All admission tickets are validated electronically when entering the event area. The ticket therefore loses its validity when leaving the event venue. The event area must be vacated 30 minutes after the end of the event, but no later than 11:30 pm.

COMMERCIAL RESALE
The commercial resale of tickets is not permitted unless an explicit agreement has been concluded between the organizer and the reseller.

Commercial resale exists in particular if tickets are sold at a higher price than the original purchase price according to the online ticket store at www.opernsommer.at. Tickets that are resold commercially and for which no agreement has been concluded can be canceled by the organizer without reimbursement of the purchase price.

ADMISSIBILITY OF SOUND, IMAGE OR FILM RECORDINGS
Filming and photography for private purposes is permitted. Commercial sound and image recordings are not permitted. The use of a tripod is only permitted if it does not interfere with other guests and all escape routes and corridors are kept clear.

NO SMOKING, OTHER DOMS AND PROHIBITIONS
Smoking is prohibited within the seating blocks in the event area. In principle, you are allowed to bring umbrellas, but they may not be opened during the event so that the view for other guests is not impaired. If it rains, the use of a rain poncho is recommended.

INSTRUCTIONS
The (security) instructions from the event and security staff transmitted via loudspeakers or in person must be followed unconditionally and immediately. Failure to follow instructions may result in expulsion from the venue.

REFERENCE
Arbitrary non-observance of (safety) instructions, brawling, drunkenness, drug consumption, littering, disturbance of the peace, disturbance of public decency and the like may lead to expulsion. In such cases, the entrance fee will not be refunded.

TAKING ANIMALS TO THE EVENT
Bringing animals to the event is not permitted.

TAKE AWAY FOOD AND DRINKS
Out of consideration for the restaurateurs in the event area, bringing your own food and drinks is prohibited.

EVENT LOCATION
The venue is an open-air area. The seats are not covered. The organizer is not liable for damage caused by natural events, in particular weather conditions, provided that the organizer has taken all measures to protect the guests and is not at fault.

LIABILITY
The organizer shall only be liable for damage caused by him or his vicarious agents, whether intentional or due to gross negligence. Liability for slight negligence is excluded. However, the limitation of liability shall not apply to damages resulting from the breach of material contractual obligations, personal injury (bodily injury, death) or claims under the Product Liability Act.

The organizer is only liable for its own content on its website (www.opernsommer.at). Insofar as links provide access to other websites, the organizer is expressly not responsible for the third-party content contained therein. Should the organizer become aware of illegal content on linked external websites, the link will be deleted immediately.

PROGRAM & CAST CHANGES
The organizer reserves the right to make changes to the program and/or the cast, as well as changes to the production, and does not entitle the holder to return or exchange tickets or to a discount on the ticket price already paid.

SEVERABILITY
The ineffectiveness of individual provisions of these General Terms and Conditions does not affect the validity of the remaining provisions of these General Terms and Conditions. The ineffective clause is replaced by a clause that comes closest to the ineffective clause in terms of its meaning and purpose, both economically and legally.
